These Terms and Conditions (“T&C”) govern participation in exoskeleton-assisted tours and rentals operated by E-Magine Travel Services Kft. (1053 Budapest, Ferenciek tere 2. fszt., company no. 01-09-295484, tax no. 25905074-2-41), hereinafter referred to as the “Lessor”. The participant is referred to as the “User”.

 

1. Subject of Agreement
The Lessor provides wearable exoskeleton equipment and accessories to the User for guided tours or self-guided rentals. The exoskeleton is a non-vehicular, body-worn assistive device designed solely to support walking activities.

2. Condition of Equipment and Instruction
The Lessor guarantees that the equipment is in proper working condition and provides safety and usage instructions prior to the activity. By participating, the User confirms understanding of correct use and suitability of the equipment.

3. User Responsibilities
The User shall use the equipment responsibly, follow all instructions, and immediately report any malfunction, discomfort, or irregular operation.

4. Prohibited Use
It is strictly prohibited to:
– allow third-party use,
– operate under the influence of alcohol, drugs, or impairing medication,
– run, jump, race, or behave recklessly,
– modify or tamper with the equipment,
– deviate from designated routes or ignore guide instructions.

5. Health Declaration
The User confirms they are able to walk independently and have no medical condition making moderate walking unsafe.
The exoskeleton is not a medical device and does not replace medical mobility aids.

6. Risk, Liability and Insurance
The User acknowledges that walking activities involve inherent risks. The Lessor maintains liability insurance covering damages caused by proven equipment failure or gross negligence. The insurance does not cover injuries or damages resulting from User negligence, rule violations, intoxication, third-party damages, fines, or personal belongings.

7. Accidents
Any accident or incident must be reported immediately. The User must not admit liability or make statements without the Lessor’s consent.

8. Damage and Loss
The User is liable for damage or loss caused by improper use or negligence. Failure to return equipment may result in legal action.

9. Age Limits
Minimum age is 14 years for guided tours and 16 years for self-guided rentals. Minors may only participate under adult supervision and responsibility.

10. Weather and Route Conditions
Tours operate in most weather conditions. The Lessor may modify routes or cancel
activities for safety reasons. In case of cancellation by the Lessor, a full refund is provided.

11. Images and Recordings
By participating, the User consents to photo and video recording for marketing purposes unless stated otherwise to the guide before the tour.

12. Data Protection
Personal data is processed in accordance with GDPR and used solely for operational and legal purposes.

13. Governing Law
Hungarian law applies. The Hungarian-language version prevails in case of discrepancy.
